Welcome. This Privacy Policy ("Privacy Policy") explains how Merryfield ("Merryfield," "us," "our," and "we") collects, uses, and shares information when you interact with us. This Privacy Policy applies to all users of Merryfield's website, www.merryfield.com, and any other websites with "Merryfield" branding that link to this Privacy Policy and any mobile device application (“App”) we offer that is branded "Merryfield" and links to or references this Privacy Policy (collectively, the "Services").
Please read this Privacy Policy carefully. If you do not agree to our practices, please do not subscribe, sign up for an account, or otherwise interact with the Services. By signing up for, using, or continuing to use the Services, you consent to the privacy practices described in this policy and you agree that we may collect, use, and share your information in the ways described. This Privacy Policy is part of the Merryfield Terms of Service. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

1. SCOPE AND APPLICATION
This Privacy Policy covers how we collect, use, and share information that identifies an individual ("Personal Information") and other data that we gather when you access or use our Services.
We offer a service that allows users to earn rewards from everyday purchases by sharing pictures of your receipts or linking your Merryfield account to your third party rewards accounts to earn points that can be redeemed for gift cards from your favorite stores.
We gather various types of Personal Information about our users, as explained in more detail below. We may collect your data to improve our app functionality, security and compliance, including information you provide, information about your transactions, information from third parties and information collected when you interact with us and our Services. How we use Personal Information and how and when we share it is described below.
The Merryfield Services are not targeted to children, and we do not knowingly collect personal information from children under 18 years of age.
This Privacy Policy applies to our collection and use of your personal information (i.e., information that identifies a specific person, such as full name or email address) in connection with the Merryfield website and Merryfield mobile app(s) owned or controlled by Merryfield. This Privacy Policy also describes Merryfield's practices for handling non-personal information (for example, demographics and services usage).
2. COLLECTION OF PERSONAL INFORMATION
The information we collect varies depending on the type of activity you are performing and helps us provide you the Services, personalize and improve your experience, and provide you with opportunities to learn about products and services that might interest you. "Personal Information," as used in this Policy, is defined as information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual. It does not include aggregated or de-identified information that is maintained in a form that is not reasonably capable of being associated with or linked to an individual.

We and our third-party service providers may collect Information in other ways, including:
Social Media: By signing up or signing in with a Social Media platform, such as Facebook Connect, you permit us access to all elements of your social network profile that you have made available to be shared. We may use that Information in accordance with the terms of use of the social network and this Privacy Policy. You can manage your sharing settings within your social media profile.
Linked Retailer Accounts: If you link an online retailer account to your Merryfield account, you are authorizing us to use the log-in credentials you provide to collect information about your shopping activity through that online account. We will monitor the retailer account and automatically log purchases that qualify for Merryfield Rewards.
Location-Based Features: Some of the features of the Services may enable us to access and collect information about your current or past location in order to personalize the Service for you and provide other features of the Services. In order to use these features, you must give us permission to use your geo-location through your device. We may access your geo-location using a variety of means, including GPS, IP address, or cell tower location. You may manage and opt-out of these features through your device's location settings. Even if you opt out of providing precise geo-location data, our App approximates your device location solely for fraud detection purposes.
Through your Device & Browser: We may collect information from and about your browsers and devices such as but not limited to your MAC Address, device type, operating system and browser name & version, device manufacturer & model number, version of our Application & Sites that are running, IP address, setting, time zone, and device language. This information is used for support, statistical purposes, fraud prevention, and to monitor Service performance & functionality.
Through Cookies: Cookies and other technologies are a form of data transferred to a user's device to facilitate customized site information and ongoing use. We use cookies for website administration and personalization, authentication, completing your requests to us, and for analysis that does not identify specific individuals. To opt out of allowing cookies to enhance your experience, you may navigate to the cookie banner on the Merryfield site and select your preferences.
Through Advertiser ID: Merryfield (and any third party with whom we have contracted) may gather and use your Advertising Identifier, which is a unique ID assigned to your mobile device for advertising purposes, and any information obtained through the use of the Advertising Identifier.
Using Pixel Tags: We use Pixel Tags or other forms of clear images and similar technologies, such as Javascript scripts, on our Website and email to understand users' actions and measure the success of our marketing efforts. This will help us deliver and improve our marketing and our content to be more relevant to your interests.
Information from Other Sources: We may collect data that is publicly available such as information you have submitted in public forums, including social media platforms. We may also collect information from third parties such as demographic information and other information that can enhance our existing information about you. We use this information to provide you services and to improve the products and services we deliver to you, including to prevent fraud and/or to verify your identity.
De-identified and Aggregated Information: De-identified information is information from which individual consumer identities have been removed and that cannot reasonably be reconnected to a particular individual. We combine de-identified information of groups of people to gain meaningful insights into developing or improving products or services, marketing, or for any other legally permissible purposes. Our customer cannot re-identify any consumer whose information was included. De-identified and aggregated information will not be treated as Personal Information.
3. USE AND DISCLOSURE
We use the information we collect from and about you to provide the Merryfield Services and features to you. This may include:
To Provide You with Requested Products and Services and Fulfill Your Request:
We may process, use, and share the information you have provided us including financial data (e.g., account transaction data, physical receipt data, online receipt data) that you provide to us and other information we collect to provide the products, services, and information you request and to otherwise fulfill your requests.
Communicating with You, Including for Marketing:
We may use your information to communicate with you if you have provided us the means to do so. For example, if you have given us your email address, we may send you newsletters, respond to inquiries, send administrative information, send promotional email offers on our own behalf or on behalf of other businesses, or email you about your use of the Services. You may receive an email from us or a Third Party to complete a purchase you have made, to follow up on sweepstakes, offers, rewards, or promotions you have signed up for, or market other goods or services that may interest you. If you want to stop receiving emails, you can follow unsubscribe links at the bottom of promotional emails or contact Merryfield as set forth in Section 8
Facebook Custom Audience:
We may participate in Facebook's Custom Audience program, which enables us to display personalized ads to individuals on our email lists when they visit Facebook. We share Personal Information with Facebook in order for Facebook to determine whether you are a registered Facebook account holder in connection with this program. You can opt-out of Facebook Custom Audience by sending us an email with your name and email address and we will forward your request to Facebook, which would delete you from all our Facebook Custom Audience ads.
Internal Business Purposes:
We may use information you have provided us or that we have otherwise collected on the Website or App to:
- Fulfill your requests and provide you with the Merryfield Services including by using financial data (e.g., account transaction data, physical receipt data, online receipt data) that you provide to us including from promotions in which you participate;
- Measure, monitor, maintain and improve those Merryfield Services and features and to develop new products and services, including conducting research and quality and safety assurance measures;
- Personalize the Merryfield Services for you;
- Improve your experience with both online and off-line Merryfield Services;
- Perform identity verification;
- Allow you to participate in online contests, other promotions or rewards programs;
- Provide you with customer support and to respond to inquiries;
- Provide you with content and advertising that is personalize and relevant to you;
- Maintain our facilities and infrastructure;
- Create anonymous, aggregated or de-identified data;
- Comply with internal policies, including accounting, audit, and other functions;
- Maintain records, and conduct risk and security controls and monitoring;
- Prevent potentially fraudulent, prohibited, or other illegal activities;
- Enforce our Terms of Service;
- Conduct research and analysis;
- Perform other business activities as needed
Business Analytics:
Merryfield uses third parties, including Google Analytics, to analyze and track the use of our Website and App, understand how our Website and App are being used, and improve performance and content. When you access our Website or App, your web browser automatically sends certain information to our business analytics providers. We do not provide them with any information that identifies you personally. You can learn how Google uses the information from your web browser here. By accessing our Website or App, you consent to the collection and use of your information for business analytics, as described in this paragraph. You are encouraged to review Google's Privacy Policy and contact Google directly if you have questions regarding Google Analytics. If you do not want any information to be collected and used as described in this paragraph, you can download and install the Google Analytics Opt-out Browser Add-on (to opt out of just Google Analytics) or use the Network Advertising Initiative Opt-Out Tool or Digital Advertising Alliance Opt-Out Tool.
To deliver relevant advertisements:
Merryfield and our service providers may use the information we collect from and about you as described in this Privacy Policy to deliver relevant ads to you when you use the Merryfield Services or another service (on any of your devices). As noted above, advertising technology companies and advertisers may use cookies and similar technologies to collect and track information such as demographic information, inferred interests, aggregated information, and information about the different devices and/or browsers you use and your activity on such devices and browsers, to assist them in delivering advertising that is more relevant to your interests. The information may also be used to deliver more relevant advertising to you across marketing channels, including email. Please note that opting-out does not mean that you will stop seeing all ads.
Business Partners:
Merryfield may partner with companies, such as manufacturers of goods, loyalty programs, or other organizations ("Partners") and collect Personal Information or Other Information to understand your shopping activity or preferences. Merryfield may use this information to provide you with information about events, promotions, sweepstakes, benefits, and goods or services that may interest you or to improve the goods or services they provide to you.
Other business affiliates and third-party service providers:
Merryfield may use other organizations to perform specific services for us as part of the core functionality built into the Website or App and to deliver Services to you. We may share Personal Information and other collected information with third party service providers to perform or help perform functions on our behalf. For example, we may share information with third party service providers for customer support services, receipt processing services, fraud detection or prevention services, crash reporting, payment processing, gift card processing or other functions of the Services.
Linking to Third Parties:
We may include links to third party websites on our Website or in ours Apps. We are not responsible for the content or availability of the linked site. If you enter into a transaction on the third party site, we are not responsible for that transaction. Also, the privacy and security policies of the linked site may differ from ours and we are not responsible for any Personal Information collected as a result of your visiting the linked site.
User profiles:
Certain user profile information, including your name, location, and any content that you post on the Merryfield website or App or send to us in an email, may be displayed to other users to facilitate user interaction within the Services. Please remember that any content you submit may become publicly available and can be collected, viewed and used by anyone. If you do not want others to see your information or any content you provide, do not post it on the site or submit it in any other way.
Allow social sharing functionality:
If you log in with or connect a social media service account with the Merryfield Services, you may share your user name. We may also share the same information with the social media service provider. By logging in with or connecting your Merryfield account with a social media service, you are authorizing us to share information we collect from and about you with the social media service provider, other users and your friends and you understand that the social media service’s use of the shared information will be governed by the social media service’s privacy policy. If you do not want your personal information shared in this way, please do not connect your social media service account with your Merryfield account and do not participate in social sharing on the Merryfield Services.
Provide co-branded services and features:
We may offer co-branded services or features, such as contests, sweepstakes or other promotions or features together with other companies (“Co-Branded Services”). These Co-Branded Services may be hosted on the Merryfield Services or on that other party’s service. By virtue of these relationships, we may share information you submit in connection with the Co-Branded Service with that party. That other party’s use of your information will be governed by its privacy policy.
Legal Requirement or Business transfers:
We may share or disclose your Personal Information when required by law or as necessary to protect our interests or those of our affiliates and/or employees or as part of a sale or purchase of our business.
Depending on your interactions with us, Merryfield may not have collected, used or disclosed information from you in each of the categories above, and to the extent that Merryfield has disclosed information from or about you, it may not include all of the information that we collect from and about you as described in this Privacy Policy.
Please note that when the information collected from or about you does not identify you as a specific person, we may use that information for any purpose or share it with other parties, to the extent permitted by applicable law.
4. SECURITY
The security of your information is fundamental to Merryfield. We have implemented industry best security measures, which include the use of firewalls and encryption to protect your personal information. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. We will retain your profile information and credentials for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
5. USER ACCESS AND CONTROL
When you log into your account or email us at support@merryfield.com, you may access, and, in some cases, edit or request deletion of the following information you have provided to us:
- Active offer lists
- Favorite product lists
- Password
- Email address
- Past receipts
You may be able to add, update or delete information. However, when changes are made, we may maintain a copy of the unrevised information in our records.
If you would like to access personal information we hold about you, or delete or correct, personal information you have previously provided directly to us, you may contact us as outlined in Section 8. In your request, please include your email address, name, and telephone number and specify clearly what information you would like to suppress. We will try to comply with your request as soon as reasonably practicable and consistent with applicable law. Please note that subject to applicable law, in some cases we may not be able to comply with your request where we may require your information in order to comply with applicable law, or to protect, enforce or defend our rights or employee rights, or those of a Merryfield Affiliate.
For California Residents:
If you are a California resident, you may request that we not share your personal information on a going-forward basis with Merryfield Affiliates or Merryfield third parties for their direct marketing purposes by sending an email as outlined in Section 8 with "Disclosure Opt-out" in the subject line and your full name, email address, postal address and the specific Merryfield Service you have subscribed to in the body of the email. We will try to comply with your request(s) as soon as reasonably practicable and consistent with applicable law. In the event that we are unable to fulfill your request, we will respond accordingly.
6. CHILDREN'S PRIVACY
We do not knowingly collect or solicit Personal Information about children under 18 years of age; if you are a child under the age of 18, please do not attempt to register for or otherwise use the Services or send us any Personal Information. If we learn we have collected Personal Information from a child under 18 years of age, we will delete that information as quickly as possible. If you believe that a child under 18 years of age may have provided Personal Information to us, please contact us at support@merryfield.com.
7. OTHER IMPORTANT INFORMATION
Updates to Privacy Policy. Merryfield may modify this Privacy Policy from time to time. Please look at the Effective Date at the top of this Privacy Policy to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Merryfield Services.
Location of Data. The Merryfield Services are hosted in and managed from the United States. If you are a user located outside the United States, you understand that by accessing the Merryfield site or Services, you consent to having any personal information processed in the United States or in any other country in which we have facilities or in which we engage service providers. The United States and other countries' data protection laws may not be the same as those in your jurisdiction. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in the United States may be entitled to access your personal information.
Linked Services. The Merryfield Services may be linked to sites operated by unaffiliated companies, and may carry advertisements or offer content, functionality, games, newsletters, contests or sweepstakes, or applications developed and maintained by unaffiliated companies. Merryfield is not responsible for the privacy practices of unaffiliated companies, and once you leave the Merryfield Services or click an advertisement, you should check the applicable privacy policy of the other service.
In addition, Merryfield is not responsible for the privacy or data security practices of other organizations, any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including in connection with any information you disclose to other organizations through or in connection with the Merryfield Services.
Data Retention. We will retain your information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required by law.
Remember that even after you cancel your registration, or if you ask us to delete your personal information, copies of some information from your account may remain viewable in some circumstances where, for example, you have shared information with social media or other services. Because of the nature of caching technology, your account may not be instantly inaccessible to others. We may also retain backup information related to your account on our servers for some time after cancellation or your request for deletion, for fraud detection or to comply with applicable law or our internal security or recordkeeping policies. It may not always be possible to completely remove or delete all of your information due to technical constraints or contractual, financial or legal requirements.

9. CALIFORNIA CONSUMER PRIVACY ACT NOTICE
If you are a resident of California, the California Consumer Privacy Act ("CCPA") requires that we give you certain specific disclosures regarding our information collection practices and gives you additional rights with respect to that information. The disclosures in this part of our Privacy Policy are provided for California residents who are covered by the CCPA.
Please note that we may process Personal Information of our customers' end users or employees in connection with our provision of certain services to our customers. If we are processing your Personal Information as a service provider, you should contact the entity that collected your Personal Information in the first instance to address your rights with respect to such data.
If there are any conflicts between this section and any other provision of this Privacy Policy and you are a California resident, the portion that is more protective of Personal Information shall control to the extent of such conflict. Categories of Personal Information Collected and/or Disclosed:
The categories of Personal Information that we collected, disclosed, and/or "sold" or "shared" are below, along with the categories of third parties to whom each category of Personal Information was disclosed, and/or "sold" or "shared". Please note that we disclose some categories of Personal Information in connection with certain types of advertisements, which could be considered a "sale" or "sharing" under the CCPA. Also, depending on the California resident's interactions with us, Merryfield may not have collected or disclosed each of these categories about each individual.
In the 12 months before the Revision Date, we collected information regarding consumers in the following categories:
- Profile or Contact name including Identifiers, first and last name, address, email address, and phone number
- Log-in credentials for online retailer accounts you choose to link to your Merryfield account
- Commercial information, such as history of Offers in which you were interested or Rewards you redeemed
- Purchase History Data including identity of the retailer, items purchased, price of items, date and time of purchase and location of retailer
- Device Information including IP address, device ID, domain server. Type of device, operating system used, browser used, connection type (cellular or wifi)
- Social network data
- Geolocation data including IP address and gps data
- Internet or other electronic network activity information, such as browsing history and information regarding your interaction with advertisements and other features on our websites
- Inferences drawn from the information described above to create a customer profile about you including information that may be considered "sensitive" under the California Privacy Rights Act
We collect the information described above from the following sources: you, internet service providers, advertising networks, data analytics providers, operating systems and platforms, and social networks.
We use the information we collect for the purposes described in the section of this Privacy Policy captioned "Collection of Personal Information"
Over the 12 months preceding the Revision Date:
- We disclosed personal information in all of the categories listed above to service providers who help us provide our Services to you and operate our business, such as payment processors, shipping companies, printing companies, analytics companies, consumer reporting agencies, and fraud protection and investigation companies.

Right to Know
You, as a Merryfield user, have:

- We will use the process described below to verify the identity of anyone who requests your personal information
- You can ask us to provide this information to you up to twice in any 12-month period
- We will not disclose information that we are prohibited from disclosing by applicable law. For example, the California Consumer Privacy Act prohibits us from disclosing your credit card number or account password.
- The right to ask us to delete the personal information that we have collected from you

- We will use the process described below to verify the identity of anyone who requests deletion of your personal information
- Please note that deleting your information may limit the Services that we can provide to you.
- Under the California Consumer Privacy Act, there are some exceptions to the right to delete under which we are entitled to keep your information. For example, we are not required to delete your personal information if we need it to complete a transaction you requested, fulfill the terms of a written warranty, or use it internally in a manner that is consistent with the reason for which you provided it

- You have the right to tell a business that sells personal information not to sell your personal information (the right to "opt out").

- We cannot treat you differently, such as by offering you different services or reducing the value of any Rewards, because you chose to exercise your privacy rights
- This rule does not prohibit us from offering different Rewards that are directly related to the value of your information to us
Verifying a Request to Disclose or Delete under California law
In order to protect your information from unauthorized disclosure or deletion, we will not disclose any information unless we believe that the person making the request is you or your authorized agent. To verify the identity of the requestor, we will ask for your name, address, and email address. We will also ask you for an additional piece of information to match information we already know about you, such as the name of a store for which you've submitted a receipt or an item you purchased in connection with an offer. We may send an email or text message with an authentication code to a device you have used previously to communicate with us. If you have a password-protected account with us, we can verify your identity by using your account authentication credentials.
If you have authorized someone else (an "authorized agent") to request information on your behalf, you must give the agent your written and signed permission. We may request that you identify yourself directly and confirm that you have authorized the agent to submit the request on your behalf.
10. FOR USERS IN VIRGINIA
If you are a Virginia resident, you have the rights set forth under the VCDPA. Please note that we may process Personal Information of our customers' end users or employees in connection with our provision of certain services to our customers. If we are processing your Personal Information as a services provider, you should contact the entity that collected your Personal Information in the first instance to address your rights with respect to such data. Additionally, please note that these rights are subject to certain conditions and exceptions under applicable law, which may permit or require us to deny your request.
If there are any conflicts between this section and any other provision of this Privacy Policy and you are a Virginia resident, the portion that is more protective of Personal Information shall control to the extent of such conflict. Right to Access
You have the right to request confirmation of whether or not we are processing your Personal Information and to access your Personal Information.

You have the right to opt-out of the processing of your Personal Information for targeted advertising purposes. We process your Personal Information for targeted advertising purpose and you have the right to opt-out of this processing by using the following methods:

The signal issued by the control must be initiated by your browser and applies to the specific device and browser you use at the time you cast the signal. Please note this does not include Do Not Track signals.
Once you have submitted an opt-out request, we will not ask you to reauthorize the processing of your Personal Information for targeted advertising purposes for at least 12 months.
Appealing a Denial
If we refuse to take action on a request within a reasonable period of time after receiving your request in accordance with this section, you may appeal our decision. In such an appeal, you must (1) provide sufficient information to allow us to verify that you are the person about whom the original request pertains and to identify the original request, and (2) provide a description of the basis of your appeal. Please note that your appeal will be subject to your rights and obligations afforded to you under the VCDPA. We will respond to your appeal within 60 days of receiving your request. If we deny your appeal, you have the right to contact the Virginia Attorney General using the methods described at https://www.oag.state.va.us/consumer-protection/index.php/file-a-complaint.

11. ADDITIONAL STATE PRIVACY RIGHTS
If you live in Colorado, Connecticut, Oregon, Texas or Utah, you may have additional rights to your Personal Information. Pursuant to the laws of these states, Merryfield may "sell" your Personal Information as defined by each applicable state law or "share" your Personal Information for the basis of cross-context behavioral advertising subject to your right to opt out.
To exercise your privacy rights pursuant to these states, please submit a request either by

- Submitting your request through the Merryfield Your Privacy Choices form.
Before processing your request, we will need to verify your identity and confirm that you are a resident of one of the states. This process may require us to request additional information from you including your Merryfield-linked email address and/or phone number associated with your Merryfield account.
California Resident Rights
Under California Civil Code Sections 1798.83-1798.84, the "Shine a Light" law, California residents are entitled to contact us to prevent disclosure of Personal Information to third parties for such third parties' direct marketing purposes; in order to submit such a request, please contact us at support@merryfield.com.
Your browser may offer you a "Do Not Track" option, which allows you to signal to operators of websites and web applications and services that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time. To find out more about "Do Not Track," you can visit www.allaboutdnt.com.
Nevada Resident Rights
If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. You can exercise this right by contacting us at support@merryfield.com with the subject line "Nevada Do Not Sell Request" and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Information as sales are defined in Nevada Revised Statutes Chapter 603A.
What choices do I have, and may I opt out?
You can always choose not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features. If you choose not to disclose certain information to us, some of our features or services may not be available to you, or the App may become unusable.
You may edit or delete information in your profile or request cancellation of your account by emailing support@merryfield.com. Some information may remain in our records after you edit or delete it or cancel your account.
